A. An eviction suit must be filed in the Justice Court in the precinct of the county in which the rental property is located.
Q. What is the first thing you have to do?
A. In your lease agreement you give them so many days they can be late before they are officially delinquient. This is ususally 3 to 5 days. Then if no payment is received we can Serve them with the a 3 Day Notice to Pay or Quit. If at the end of that time they have not paid or you choose not to let them restore the lease contract by payment you submit a Forcible Enty Detainer at the Justice of the Peaces office, pay the fee which varies depending on the Precinct and County. Then you obtain a court date to have the Judge tell them to Pay or Quit (Leave the property).
Q. How is the 3 Day Notice to Pay or Quit deliverd?
A. We Post one or two notices at the property, usually the front door and one the garage door. Then we mail a Certified with a Return Receipt Letter and also send a regular postage stamp letter to the tenant.
Q. How long does an eviction take?
A. In the State of Texas about 3 to 4 weeks.
